Today, 4 June 2021, the European Commission adopted two sets of much-awaited standard contractual clauses (SCCs). The modernized SCCs mark an important step towards potentially increasing legal certainty in the complex and global data-driven economy. The new SCCs consider the Schrems II decision and the subsequent opinions of the Supervisory Authorities. A transition period of 18 months is provided for organizations (controllers/processors) that are currently using the previous sets of standard contractual clauses.
One set of the new SCCs is for use between controllers and processors, available here, and one is for the transfer of personal data to third countries available here.
